Terms of service
Last updated: 2026-09-29
1. Scope
These terms govern accessibility audit services supplied by SIA Amber Cloud, registration number 40203546908, of Ieroču iela 14-4, Rīga, LV-1013, Latvia. The services are offered only to customers purchasing for purposes connected with their trade, business or independent profession. By ordering, you confirm that the customer identified in the order is purchasing for those purposes and that you are authorised to enter into the contract on that customer's behalf. We do not accept orders for personal or household purposes. Deviating terms of a customer do not apply unless we have agreed to them in writing.
2. What we provide
We test the website you specify against WCAG 2.1 Level AA using automated tools together with AI analysis, and deliver a report containing findings, suggested code fixes, a statement of what was tested, and a checklist for the criteria that require human evaluation.
Automated testing cannot cover every success criterion. We audit a representative sample of pages, selected as described in the quote you accept, rather than every page of your website unless expressly agreed.
The audit assesses the pages and test scope identified in the accepted quote, in the state available when testing takes place. Findings and suggested fixes may require human verification. Unless expressly included in the quote, the service does not include manual accessibility evaluation, remediation, certification, a statutory conformity assessment or legal advice. A report with no detected issues does not establish that the website meets every applicable accessibility requirement.
3. How a contract is formed
The presentation of our services on this website is not a binding offer. By accepting a quote and completing payment you make a binding offer. The contract is concluded when we send you an order confirmation by email; the confirmation contains the accepted quote and the versions of these terms and the Data Processing Agreement that apply to your order, in a form you can retain. A payment receipt from our payment provider is not in itself acceptance. If we do not accept your order, or the audit cannot be started, we refund the payment in full within 14 days.
4. Prices and payment
The price applicable is the one shown in the quote you accept. Prices are exclusive of VAT; our offer is directed exclusively at business customers. VAT is applied at checkout and shown before you pay: customers in Latvia are charged Latvian VAT at the statutory rate (currently 21%). Business customers established in another EU member state whose VAT identification number is validated in VIES are invoiced without Latvian VAT under the reverse-charge mechanism and account for VAT in their own member state. EU business customers who have not provided a validated VAT number are charged Latvian VAT at the statutory rate — the treatment for electronically supplied services while our qualifying cross-border sales remain within the EU EUR 10,000 exception. For business customers established outside the EU we do not charge Latvian VAT on this supply; whether tax is due in your own jurisdiction depends on its rules. Enter your VAT number at checkout so the correct treatment can be applied. Payment is one-time; there is no subscription and nothing renews automatically.
Payment is due immediately and is processed by our payment provider. You receive an invoice by email.
5. Right of withdrawal (consumers)
This section applies only if, notwithstanding Section 1, you qualify as a consumer under applicable law. In that case you generally have the right to withdraw from a distance contract within fourteen days of its conclusion, without giving reasons.
To withdraw, use the withdrawal form at geta11y.com/legal/withdrawal, or send an unambiguous statement to info@geta11y.com or to our postal address within the withdrawal period; you may use the model form below. If you withdraw, we refund all payments received within 14 days, using the same means of payment you used, at no fee.
Model withdrawal form
(Complete and return this form only if you wish to withdraw from the contract.) — To SIA Amber Cloud, Ieroču iela 14-4, Rīga, LV-1013, Latvia, info@geta11y.com: I/we hereby give notice that I/we withdraw from my/our contract for the following service: [order or audit reference], ordered on [date]. Name of consumer(s), address of consumer(s), signature (only if this form is notified on paper), date.
If you are acting in a commercial or professional capacity, the statutory right of withdrawal does not apply.
6. Your obligations
You may only submit websites that you own or that you are authorised to have tested. You are responsible for ensuring that our automated access is permitted. Our tools identify themselves and respect robots.txt for crawling, and they load pages the way a browser does — which, like any visit, appears in your server logs and analytics. Where forms are examined, test entries are made inside the test browser and requests that would submit those entries to your systems are blocked before leaving the browser. We do not create orders, accounts or messages by design; we cannot rule out side effects on websites where ordinary page loads themselves change data, contrary to standard HTTP semantics, so do not point us at systems where loading a page has irreversible effects.
7. Delivery and remedies
We start the audit after the contract is concluded and any required consents and instructions have been given, and deliver the report to your account — usually within hours, and at the latest within three business days (business days meaning Monday to Friday other than Latvian public holidays; delays you cause, such as blocking our access, extend the period accordingly). If the website cannot be retrieved or the audit fails, we tell you and offer a free re-run; if the re-run does not deliver within five business days of the original conclusion, or if you prefer not to wait, you receive a full refund. If a delivered report is materially incomplete or defective, we re-perform the affected part; if we cannot remedy it within a reasonable period, you receive a proportionate or, where the report is unusable, a full refund. Refunds are issued within 14 days to the original payment method, without fees. Quotes are valid for the period shown on the quote. Re-audit prices are shown separately when you order a re-audit. Reports remain available in your account for 2 years from delivery, unless you delete them earlier; longer retention is available as a separately agreed instruction.
8. Warranty and liability
We do not warrant that an audit establishes legal compliance with the European Accessibility Act, the BFSG or any other legislation. Automated testing supports expert evaluation; it does not replace it, and no provider can promise a legal outcome.
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation, and then limited to the foreseeable damage typical for this type of contract, capped at the greater of the total price paid for the audit concerned and EUR 1,000. This cap does not reduce your right to the refunds and re-performance promised in these terms, and it applies to claims under the Data Processing Agreement only to the extent mandatory law permits. Mandatory statutory liability that cannot lawfully be excluded or limited remains unaffected.
9. Rights to the report
On full payment you receive an unrestricted right to use the report and the code fixes it contains for your own purposes and — where you commissioned the audit for a client whose website it concerns — for that client's purposes, including passing the report and fixes to the site owner, your developers or your client. We retain the rights to the underlying software and methodology. Suggested code fixes may include AI-generated material; you are responsible for reviewing changes before deploying them, and no exclusivity in general techniques or third-party material is granted.
10. Applicable law and jurisdiction
Latvian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If, notwithstanding Section 1, you qualify as a consumer resident in the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence, and mandatory jurisdiction rules remain unaffected. For business customers, the courts of Rīga, Latvia, have exclusive jurisdiction.
11. Contract language
The contract is concluded in English. Translations of these terms are provided for convenience. If a translation differs from the English version, the English version prevails to the extent permitted by applicable law. This provision does not restrict any mandatory rights or mandatory language requirements.
